I write to you in your capacity as the domain name registrant of the www.XXX.co domain
name (hereinafter referred to as the “Domain Name”) to demand that you cease and desist certain
practices that infringe on Learnvest, Inc’s (“XXX”) registered trademark, which consists of
the word LEARNVEST (see U.S. Registration Numbers 4,491,951 and 4,063,812), and violate
the Anti-Cybersquatting Consumer Protection Act of 1999 (“ACPA”).
The ACPA prohibits an individual from registering, trafficking in or using a domain name that “is
identical or confusingly similar to or dilutive of” a famous mark, such as Learnvest, with a “bad
faith intent to profit from that mark.” See 15 U.S.C.A. § 1125(d). The ACPA allows
Northwestern Mutual, in behalf of its subsidiary, XXX, to seek “forfeiture or cancellation of
the domain name or transfer of the domain name to the owner of the mark.” Id.
Accordingly, in the event that your webpage uses the Learnvest mark to attract users and divert
them to competitors, Northwestern Mutual could submit the matter to the Internet Corporation
for Assigned Names and Numbers to be resolved under its Uniform Domain Name Dispute
Resolution Policy (the “UDRP”). Pursuant to the UDRP, when
(i) the Domain Name is confusingly similar to our trademark;
(ii) the user has no rights or legitimate interests in the Domain Name; and
(iii) the user has registered and used the Domain Name in bad faith, we have
the right to have the ownership of the Domain Name transferred to us. Furthermore, please be
advised that arbitration decisions applying the ACPA routinely hold that “typosquatting
[registration of domain names that purposefully misspell a famous mark] is inherently parasitic
and of itself evidence of bad faith.” See, e.g. Nat’l Ass’n of Prof’l Baseball Leagues, Inc.,
d/b/a/Minor League Baseball, No. D2002-1011. The UDRP allows Northwestern Mutual to
request a “transfer of [the registrant’s] domain name registration.” UDRP ¶4(i)
